It is true that a new scheme has been implemented for all road traffic accidents, occuring on or after 3oth Aprill 2010, but please note that this new scheme only applies to any injury claims valued up to £10,000. The aim behind this new scheme is not to restrict your right to claim but rather try and improve the efficiency of the settlement process at a lower cost to all paries involved.

Should you be unfortunate enough to be involved in a road traffic accident on or after 30th April 2010 then your solicitor would complete an extensive claim notification form for you. This form would then be lodged via a website portal http://www.rapiclaimsettlement.co.uk/

This is a web portal specifically created for use by personal injury lawyers and insurance companies. Once the claim is lodged the at fault insurance company is under pressure to acknowledge the claim within 15 working days and confirm whether liability for the accident is admitted or not.

Once liability is conceded your solicitor may then arrange for you to be examined by a doctor before submitting the medical report and bany other evidence relating to any out of pocket expenses via the portal with an offer to settle the claim. The respective insurance company are again allowed only 15 working days in which to repsond to the offer. Negotiation can then take place if the offer is not accepted after this time.
Once an award as to any compensation is agreed then the at fault insurance company has 10 days from acceptance in which to pay any compensation.

Therefore as you can hopefully see, the intention is to further refine and improve the procedure for settling any claim for financial losses and personal injury arising from a road traffic accident or car crash.
The above is a very brief summary of the new scheme and hopefully you'll will appreciate that there is more involved. However, the procees, which has been running for 10 months now, is simpler and quicker than it was before.
